CA Brokerage Hoax 2023

Have you ever seen the term "Hoax" used to describe a real situation accurately?

Do you know some of the proper definitions for it that go beyond a joke
with a deviant twist?

I didn't.

I always thought it was just another term for "trick" or "prank",
with a small context.

I'm glad I found the larger meanings for it.
Without those, I was struggling to convey in many words
what can be summarized in one.

a) "A plan to deceive a large group of people. A trick"

b) "To Trick into believing or accepting as genuine something false
and often preposterous"

If I told you there were approximately 440,000 Licensed Real Estate Professionals in California, and then I told you many of them were victims of a Hoax that was being perpetrated by a few of them on their peers as well as the public, could you suspend your disbelief long enough to hear me out?

I hope so.
It won't take long, even though this Hoax is
REALLY DAMN BIG AND GNARLY.

The Agents, Brokers and Real Estate Attorneys who have been fooled should feel shame,
but they've all profited from it one way or another,
and it's impossible to believe many of them were in fact fooled.

The Buyers and Sellers harmed by this, on the other hand,
have been robbed for BILLIONS of DOLLARS and had their confidence in
social peers permanently rattled.

All 440,000 of these people went through educational programs
and they are subjected to Continuing Education regularly.
With just 10 minutes of attention this should have ended years ago.
As a result, none of them are now without fault.
Surely, warmer beds will greet them when the time is right.

Hypnosis and "Lock Step" Scenarios are hard to see until the Trance is broken.
After that, the manipulation is impossible to forget for a lifetime.

Please don't accept this Commercial Corruption Disclosure as
"just another thing to add to the list".

There's no need for this one to be that way.

This isn't that way it is in 49 other states,
and there's no need for it to be this way in California either.

California is the 6th largest economy in the World.

The Real Estate Industry in it needn't be run by those who lie, cheat and steal to make a living.
No changes in Legislation need to be made. Existing Rules and Laws simply need to be enforced ,
and HARSH penalties need to handed down to 440,000 participants.
Because those with eyes blind had to work hard to keep this information
out of their own purview , too.

This HOAX - Sensitization to "Clause 14A"

This HOAX revolves around contract clause 14A, hugely relevant clause the defines behavior in the transaction process that suggests a buyer is in a lesser position than California Law provides and Common Sense demands.

The Prose in Clause 14A is preposterous because the ethos of the clause was inverted by someone who controlled the Prose in these Contracts some years ago.

Clause 14A creates mental conflict and confusion that novice Buyers and Sellers in California may be told is just a "qwerk of real estate" or "just the way it is", when in fact the law says otherwise, as do Professionals in 49 other states, as do the basic tenants of "preposterous behavior". The inversion of Clause 14A is reinforced with several other confusing contract clauses that had to be manipulated for 14A to blend in.

Confusion created by Authority figures deemed to be "Professionals" is one of several Hypnotic Induction techniques that can be called upon anytime an Agent or Broker needs to use it to get a Buyer or Seller to do something with less opposition or friction, because that's how confusion can be used.

Those who created the standard California Real Estate Contract you will be introduced to, referred to as the "CA-RPA", short for "California - Residential Purchase Agreement", created a "Stage Hypnosis" scenario without a stage, and without the comedic backdrop.

Those who did it and those who can see it and use it to their advantage would have to think it's funny as heck, but you'll never hear them say that unless James O'Keefe and Company can get them on a hidden camera or some Whistle Blowers step out of the reeds.

Brokers and Agents who turned a blind eye have been taking excess money from transaction participants and manipulating them for years with a Hoax. It's brought them money, and controlling others mentally, especially those who deem themselves to be in a higher social strata, makes them feel powerful. They've manipulated Millions.

Taking subtle mental control of transaction participants without their knowledge in a Real Estate transaction can benefit the the Real Estate Professionals, the Seller, and/or the Buyer. It is a tool and/or a weapon to be used. It's unbiased.

Used by a Professional Manipulator, hypnosis and mind control can be wielded any way a Trained Professional might want to use it. I know that for a fact, because I'm one of them, too. I've never participated in their Real Estate schemes, and I try very hard to keep them out of my commercial dealings. For me, unconscious manipulation takes the fun out of it, but I'm with the oddballs in that regard. We are the ones who can see them and follow them, but care not to play along with them.

Once you see how this works, things may get a little more gnarly for a while, as if things aren't already gnarly enough, because once you see what they've done here, in plain sight, without any singular, overriding individual that can be said to be controlling the Hoax, as can found more frequently in Corporations, Governments, and Groups like the WEF, when it's done there, you will be able to more easily see varying levels of other seemingly transparent controllers across your Commercial spectrum.

This Commercial Hoax was sitting way too far out in plain view to miss,

California Code "CA 1102" is referenced frequently in the Purchase Contract used in California, but CA 1102 details are NOT not provided in the Contract and the Contract, as written, CONTRADICTS the mandates of CA 1102 for Consumer Protection

CA 1102 was created in 1994 in California to codify and regulate "Disclosure Statements", "Disclosure Documents" , "Disclosure Behavior" in Real Estate Transactions.
It was created for "consumer protection".
It was created to make sure buyers and sellers were competing in a fair and honest marketplace
It establishes expectations for "good behavior" and a baseline for identifying "bad behavior".

"Disclosure Statements" are statements that shed light on "material" facts and defects that a Casual Observer could not surmise in "social visit" to the home.

Think of them as being statements about a property that a Seller must make to a Buyer to let them know about things that might affect the Buyers pricing valuation.
- - "The home floods when it rains for more than two days" for example.
  - "The Central Heat isn't sufficient in the dead of winter, we have to supplement the heat to keep the pipes from freezing for about 2 weeks a year" for example
They must be made about defects that a Casual Observer could NOT surmise in a casual walk through of a home.
The term "material" means there is, or may be, a financial value associated with the fact or defect that a buyer would want to consider in pricing. If something is "material", it likely affects the amount of money in your pocketbook.

INTRODUCTION to the three relevant Clauses in CA 1102

CA 1102 has a dozen or so Clauses, but only THREE are relevant for your introduction to this Hoax.

CA 1102.7 specifies Good Faith as a Requirement. Just like a Boxing ref says "fight fair", this is that instruction for a real estate transaction.
CA 1102.6 identifies the "Transfer Disclosure Document" (the TDS) as a Required Disclosure Document. It asks questions like "Are there any problems with property flooding or the heating system that you are aware of...".
CA 1102.3 indicates the TDS must be provided at a time "practicable and prior to Transfer of Title" (practicable means "useful")

In plain English...

A Seller is required by State Law to fill out a "Transfer Disclosure Statement" document.
That document contains many questions about the property that require answers.
Those questions force a seller to think about and reveal details about material facts and defects that might affect property value, and that document helps prevent a seller from later saying, "Oh my gosh, did I forget to tell you about that?" without negative consequences to the Seller for omitting material information (information that affects value).

INTRODUCTION to the three relevant Clauses in CA 1102

"Practicable" means useful. Thus, that document needs to be presented to the Buyer "at a time that is useful", which is BEFORE HE/SHE makes an offer, and most certainly before that Offer is Accepted.

ME to YOU

Ideally, all material disclosure statements are provided public-ally or upon request during a buyers consideration process.
Sometimes offers are made with an expectation that disclosure statements with nothing material relevance will be provided BEFORE that offer is ratified.
Never should offers be made or accepted if there are material disclosure details that exist that the Buyer has not been informed of. That is not dealing in "Good Faith".

YOU to ME

"If the Disclosures are due before he/she makes an offer, why did they say "Prior to Transfer of Title"?
Why didn't they say "During the buyers consideration process"?

You've just asked the Multi-Million Dollar Question!
This HOAX is built entirely around something that looks confusing, if you don't have all the facts about the TWO TITLE ownership system.
There are two types of Title and Two Title Transfers related to a Real Estate Transaction.
- Equitable Title Transfers at the time the Contract is Accepted.
  - The Contract itself represents a type of "right to ownership"
  - The Contract , after fully agreed to by both parties, is a negotiable document that can be assigned by the Buyer to someone else, just like a check you receive from someone else can be endorsed to a third party. Thus "Transfer of Title" in 1102.3 is synonymous with "Contract Acceptance".
- Legal Title Transfers at time of "Deed Conveyance" which is typically 1 to 6 weeks after the Transfer of Equitable Title
  - During this transitory period, due diligence is done by the Buyer to confirm the seller made truthful disclosure statements
  - During this transitory period, lending matters for the buyer and seller are reviewed for the creation of new loans and the payoff of existing loans.

If it's so important to get these before the first Transfer of Title, why didn't they just say that more explicitly? Why leave it vague?

ME to YOU

Because the worlds is imperfect.
Many things come up during that transitional period that made need clarification. Honest accidents transpire in disclosure process. It's common to have to clarify or add to disclosures to document the mutual understanding of the parties during the transitory period.
Thus, that statement, "at a time practicable, prior to Transfer of Title" is UNIVERSAL. The exact same statement applies to the time when the buyer is considering the pricing on the property as well as the time after the Contract has been Accepted and before the Deed has conveyed.
In fact, when you understand that, you realize the real key word that can be used to determine damaging negligent and/or fraudulent behavior is in fact "practicable".
- - "Hey, it would have been useful to know the attic had 10k in damage BEFORE we ratified a contract for the sale price. We should not have been forced to find that during our inspections. You were not operating in Good Faith and that has consequences".
  - "Hey, it would have been useful to know the fascia had been puttied to cover up drywrot BEFORE we ratified a contract for a sale price. We should not have been forced to learn about that during our inspections. You were not operating in Good Faith and that has consequences."
  - "Hey, it would have been useful to know the property flooded during rainy season BEFORE we ratified a contract for a price and BEFORE we took legal title. You were not operating in Good Faith and that has consequences"

The HOAX is not subject to Debate. The Contract verifies all the Details needed to Expose it...

Contract Clause 13B indicates Transfer of Title transpires at time of Contract Ratification / Contract Acceptance.

We realize this may not sound right.
The contract says this and it's right.
We'll discuss this in more detail later.
The bias you may have against this thought is what was used to create and sustain the hoax.

THUS, CA 1102.3 and Contract Clause 13B together indicate the TDS must be provided prior to Contract Ratification and/or Contract Acceptance

In context, that makes perfectly logical sense.
A Seller needs to tell a Buyer about home defects BEFORE they make an offer to purchase the home.
It's the only way to make a prudent offer and it's the only way to do real estate transfers "in good faith".

So far so good. Now comes the HOAX.

Clause 14A states:

"SELLER HAS 7 (or ____ ) Days After Acceptance to Deliver to the Buyer disclosures which seller is responsible for.

Do you find the use of the term "Acceptance" odd? What are they referring to? Acceptance is in fact defined in another part of the contract as "Contract Acceptance". That's just the first step to setup the confusion.

I paraphrased the information above to give you an initial step up.

Take a look at this in the image below. without the paraphrasing.

Notice the varying of the Bold and non Bold fonts mixed together (My highlights don't help but try to ignore them.)
Then notice the arbitrary capitalization and lower case leading letters.
Of most interest, notice that "Reports" is capitalized and "disclosures and information" is not. It's some of the few nouns not capitalized. Why did they emphasize Reports as a formal noun and disclosures as informal? Why did they capitalize "Delivered"?

All of it is done to create confusion and a a subconscious suggestion that "disclosures" are less relevant than "Reports".

Collectively it's designed to causes you to slip into a suggestive / hypnotic state for easier manipulation so you will accepted a FULLY INVERTED CONTRACT CLAUSE that suggests the exact opposite of what is supposed to transpire is proper and legal.

Clause 14A is a fully inverted Clause.

It suggests the Seller can do something that is the exact OPPOSITE of what the seller is required to do by state code and that which is also logical in the context of disclosing facts about a property at a time useful to the Buyer so they can make a prudent offer.

What you are looking at is a screen shot from our Contract.

A footer indicates the Contract was approved by the California Association of Realtors for State Wide use
It is currently used by all Brokers in the State of California.
It also happens to REPRESNET A GROSS ACT OF FRAUD and RACKETEERING.
It also happens to fit the second definition of a HOAX to a TEE.

Processing the HOAX - they rely on Doubting Thomas's to sustain the narrative.

You've been raised with "Innocent until proven guilty" as a mantra.

You've been raised to play "Devils Advocate".

Many of you will not be able to accept this at face value.

You will seek "Professionals" who have their reputation to lose to tell you this is or is not factual instead of allowing your own eyes and your own mind to just process the simplest of facts.

They rely on all of your Biases and insecurities to sustain this type of Hypnotic manipulation.

My Attorney once told me that if a case goes to court, the Judge and Jury assume both sides are lying from the get go. They decide in advance the truth must be in the middle.

If that's you, you will take away 50% of my credibility without any critical thinking and you will give the lying side 50% credibility they should not have
Then you will start your assessment, and at that point, the lying side has already won.

We were all Brainwashed in far more ways than one.

Almost everything you believe about how commerce , work, US Government and US society operate or should operate are manipulated and inverted.
It was all done by Globalist Controllers to keep them in the Cat Bird Seat in the US until they could setup more home bases in other countries. Many of those are now rising like rockets with our neon signs of old, and a feel of US optimism that may have existed briefly many years ago; as they leave us in the dust and burn the place down on the way out.

Practicable means "useful", and "Transfer of Title" transpires at time of "Contract Ratification" and/or "Contract Acceptance" , with the latter fact is defined clearly in the

The idea that a Seller transfers or loses Title to their own property before they are paid for the home and before they move out may seem odd to most novices, and they prey on that doubt.
It's actually not odd once you think about things logically. Without Transfer of Title at the time of Contract Acceptance the sales process can not work properly. The Seller would never be bound to any commitment to sell or move out of the home. Without that level of commitment from a seller, a buyer and the banks could never be confident they had a deal until time for money transfer , and even then they'd have no binding commitments the seller would vacate the home once money was given to them. Transferring Title at the end does not make for a good property transfer industry.
At time of Contract Acceptance, the seller still maintains a legal right to occupy the property for a short time while the disclosure statements they made about the property are confirmed and the financial details are worked out, but they no longer have a right to stay in the property after the agreed upon closing date. They have "terminated their rights to occupy the home after the agreed upon closing date" just by agreeing to sell it.

In context, what this means

Disclosures in Real Estate refer to written statements made be Sellers and Buyers to "declare knowledge about the properties and themselves" that would not be known to a casual observer, such that each party could properly assess property value and their opponents in a fair competition related to home transfer negotiations.

CA 1102.7 declares "Good Faith" must transpire in Disclosure Statements and the Disclosure process. Much like the opening in a boxing match where the combatants are told to "fight fair", this is that in differnt form.
